California Marijuana Licenses

With the recent passage of the Medical Cannabis Regulation and Safety Act (MCRSA) in 2015 and the Adult Use of Marijuana Act (AUMA, Proposition 64) in 2016, California is poised to legalize an entire industry in 2018 that has operated in the shadows for decades. Although the existing legal market for medical marijuana is expected to decrease slightly by 2020 based on 2015 projections ($2.7 vs. $2.6 billion), the new legal market for recreational marijuana is anticipated to reach more than $2 billion (Arcview Market Research and New Frontier). With experience, both outside the industry as consultants and inside the industry as cannabis operators, we are intimately familiar with the opportunities and obstacles facing marijuana businesses over the next few years. Whatever stage you are with your marijuana business, we can assist you in obtaining your state license as quickly and efficiently as possible.

Commercial Cultivation Licenses

Whether you are a small cottage grower (<2,500 s.f.) or a large grower encompassing a half-acre or more, you will need to obtain a cultivation license from the California Department of Food and Agriculture starting in 2018. While the specific state licensing requirements remain ambiguous, approval is reliant on a dual licensing structure requiring both a local and state approval. Additionally, many requirements at the local level, such as background checks, local permits, or environmental permits, will also be required when applying for a state license.

Our consultant team can help you prepare for your state license application now by taking the first steps toward securing a facility approved by a city or county. Whether you are looking for the right location, or already own property in an approved zoning area, we can assist you in planning how to develop your business.

Cannabis Manufacturing and Testing Licenses

Cannabis manufacturing and testing licenses are expected to be issued starting in 2018 by the California Department of Public Health and the Department of Consumer Affairs, respectively. Manufacturing licenses are required for any business producing a product derived from the marijuana flower, such as edibles, topicals, vape cartridges, and concentrates. Testing licenses are required for laboratories examining cannabis flower or manufactured material. Obtaining a marijuana manufacturing or testing license involves a dual license system in which a business must first obtain local approval from the city or county in which it is located before a state license application will be accepted. Our consultant team can assist you in preparing for your state license submittal now by obtaining the local and environmental approvals you will need.

California Dispensary Licenses

Opening or operating a California marijuana dispensary is a challenge in many ways. As the most visible type of business in the cannabis industry, operators have faced significant criticism from opponents claiming dispensaries will lead to more crime and degradation, exposure to and corruption of minors, impacts to other businesses and property values, and many other arguments. Strategic planning is therefore essential in obtaining your dispensary license. Whatever your goals, our consultants can help you obtain your approvals quickly while maximizing the effectiveness of your time and money.

Distribution and Transportation Licenses

Distribution and transportation are new types of cannabis businesses identified in recent state legislation. By providing a separate license for these activities, legislators hope to limit vertical integration in the industry, which reduces the likelihood of monopolies and diversion of cannabis products to the black market. Additionally, the distributor model helps to increase the quality of products reaching the retail market and facilitates tax collection. While typically less controversial than other marijuana businesses, distribution and transportation businesses face a high degree of scrutiny regarding inventory management and recordkeeping. Our consultants are well-versed in the complexities arising from these business models. We can help you obtain your license and stay in compliance with state regulators.
